We Power America (also known as “We Power North America”) collects personal information about job applicants to connect applicants with potential employers and/or hiring halls.  That information is not sold to or shared with any other entity, nor is it collected without your consent.  We Power America collects resumes, licenses, and other documents through its Power Pass form and through other online job application forms (e.g., on Indeed) that may include personal information.

1.             Personal Information We Collect About You

In the last twelve (12) months, we have collected the following types of personal information through the Power Pass form and through other online job application forms:

Identifiers (e.g., a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifier).

Name, postal address, email address, social security number, driver’s license number, state identification card number.

Characteristics of protected classifications under state or federal law.

Race, gender, national origin, citizenship status, union membership.

Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, their name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.

Name, signature, social security number, address, telephone number, driver’s license number, state identification card number, education, employment, employment history, industry licenses.

Professional or employment-related information.

Employment history, industry licenses.

Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (FERPA).

Educational history and certificates.

Personal information that reveals an individual’s social security, driver’s license, state identification card, or passport number.

Social security number, driver’s license number, state identification card number.

Personal information that reveals an individual’s racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union membership.

Race, gender, national origin, citizenship status, union membership.

Some of this information may be included on documents submitted to We Power America through its Power Pass form and through other online job application forms.  We Power America does not need and does not intend to collect personal information that is irrelevant to your contact information, work and educational history, and qualifications.  Please redact any social security numbers, driver’s license numbers, state identification card numbers, license numbers, and other similar personal information from documents uploaded through the Power Pass form or other online job application forms.

2.             How Your Personal Information Is Collected

We collect all of this information directly from you through the Power Pass form and through other online job application forms on our website or on Indeed, LinkedIn, or other similar job sites.  We will not collect any personal information from you without your consent.

3.             Why We Collect Your Personal Information

a.    Power Pass

We collect personal information through the Power Pass form with your consent to share employment qualifications with hiring halls and/or contractors looking for applicants to refer to work.

b.    Job Application Forms

We collect personal information with your consent to share employment qualifications with hiring halls and/or contractors looking for applicants.

4.             Who We Disclose Your Personal Information To

a.    Power Pass

In the last twelve (12) months, we have disclosed personal information collected through the Power Pass form with hiring halls and/or contractors looking for applicants for work.  We only allow these entities to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information.  We require hiring halls and/or contractors looking for applicants to use your personal information only to provide services to you.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.  We will not share your personal information with any other third party.  We will never sell your personal information.

b.    Job Application Forms

In the last twelve (12) months, we have disclosed personal information collected through job application forms with hiring halls and/or contractors looking for applicants for work.  We only allow these entities to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information.  We require the entities to use your personal information only to provide services to you.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.  We will not share your personal information with any other third party.  We will never sell your personal information. 

 

5.             Categories of Personal Information We Disclose for Business Purposes

a.    Power Pass

In the last twelve (12) months, we have disclosed each of the types of personal information listed in section 1 and collected through the Power Pass form to hiring halls and/or contractors to help connect them with job applicants.  We have not sold or shared any personal information for any reason other than for business purposes.  We have not knowingly sold or shared the personal information of anyone under sixteen (16) years old.

 

b.    Job Application Forms

In the last twelve (12) months, we have disclosed each of the types of personal information listed in section 1 and collected through online job application forms to with hiring halls and/or contractors to help connect them with job applicants.  We have not sold or shared any personal information for any reason other than for business purposes.  We have not knowingly sold or shared the personal information of anyone under sixteen (16) years old.

6.             How Long Your Personal Information Will Be Kept

We will keep your personal information (whether collected through the Power Pass form or through other online job application forms) as long as is necessary to respond to any questions, complaints, or claims made by you or on your behalf; to show that we treated you fairly; and as required by law.  We will not retain your personal information for longer than necessary for the purposes set out in this policy.  When it is no longer necessary to retain your personal information, we will delete it from our records.

7.             Your Rights

Disclosure of personal information we collect about you.  You have the right to know and request disclosure of:

  • The categories of personal information we have collected about you, including sensitive personal information.
  • The categories of sources from which the personal information is collected.
  • Our business or commercial purpose for collecting, selling, or sharing personal information.
  • The categories of third parties to whom we disclose personal information.
  • The specific pieces of personal information we have collected about you.

Disclosure of personal information.  You have the right to know what categories of information we share, sell, or disclose for a business purpose, as well as the categories of persons to whom your personal information is shared, sold, or disclosed.  Other than disclosing your personal information to hiring halls and/or contractors for business purposes as provided above, we will never share or sell your personal information to third parties.

Right to limit use of sensitive personal information.  You have the right to limit the use and disclosure of your sensitive personal information to the use which is necessary to:

  • Perform the services reasonably expected by an average consumer who requests those services.
  • Perform the following services:
    • Helping to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for these purposes.
    • Performing services on behalf of the business, including maintaining or servicing accounts, providing customer service, verifying customer information, or providing similar services on behalf of the business.
    • Undertaking activities to verify or maintain the quality or safety of a service that is offered by the business, and to improve, upgrade, or enhance the service that is offered by the business.
  • As authorized by further regulations.

You have a right to know if your sensitive personal information may be used, or disclosed to a service provider or contractor, for additional, specified purposes.  Other than disclosing your sensitive personal information to hiring halls and/or contractors to provide job application services requested by you as explained above, we will never use your sensitive personal information for any other purpose.

Right to deletion.  Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records.
  • Direct any service providers or contractors to delete your personal information from their records.
  • Direct third parties to whom the business has sold or shared your personal information to delete your personal information unless this proves impossible or involves disproportionate effort.

Please note that we may not delete your personal information if it is reasonably necessary to:

  • Provide a service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us.
  • Help to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for those purposes.
  • Debug to identify and repair errors that impair existing functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law.

  • Otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided the information.

Right of correction.  If we maintain inaccurate personal information about you, you have the right to request us to correct that inaccurate personal information.  Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

No retaliation.  You have the right not to be retaliated against because you exercised any of your rights under this policy or applicable state or federal law.  This means we cannot, among other things:

  • Deny services to you.
  • Impose penalties.
  • Suggest that you will receive a different level or quality of services.
